DOT/SAP Evaluations

Return to Duty Process for Employees

Before you can return to a DOT safety-sensitive position, you must successfully complete a return-to-duty process as outlined in CFR Part 40.

A Substance Abuse Professional (SAP) must:

  • Conduct a thorough face-to-face DOT/SAP Evaluation
  • Present recommendations for education and/or treatment
  • Send a report to the employer about that recommendation
  • Monitor employee’s progress within that plan
  • Conduct a face-to-face follow-up DOT/SAP evaluation to determine compliance
  • If appropriate, Update the FMCSA Clearinghouse to indicate RTD status.

If the SAP determines the treatment was successful, the SAP will send a report of compliance to your employer. Employees can then take a Return to Duty test or a Pre-Employment test for a new employer  (The specimen collection will be observed).

If the SAP determines NON-compliance, the SAP must send a report of non-compliance to your employer.

Employees that successfully return to duty will face follow-up testing as well.

The SAP must outline a follow-up testing plan of no fewer than 6 unannounced tests, over at least 12 months.  However, the SAP may require any number of tests, over 60 months.  The specimen collection will be observed.
